ITAR and UK Origin Techincal Information


 

The British Embassy in WashingtonDC has passed the DMA the following information:

We have been informed that UK Industry was, quite rightly, complaining about being disadvantaged by US contractors refusing to forward MOD originated data to prospective UK sub-contractors without a Technical Assistance Agreement (TAA).  We decided to approach the US on this point.

By means of the Bi-Lateral Defence Acquisition Committee (BDAC) Roadmap we have now clarified the true position with the US.   In a nutshell we have confirmed that US Export Laws do not require a TAA for the return of UK originated data.   However, there is a caveat to the effect that if such data is co-mingled with US information a TAA is still necessary - which is to be expected. 

However, we can now at least get back to UK industry to let them know that any claim by a US contractor that the transfer of MOD originated data is not possible without a TAA is incorrect and that this has been agreed at an inter-governmental level. 

We can now put a stop to such practice and help give our own contractors a more even chance.
